With the increasing popularity of patents, a career as a patent agent seems to be a lucrative option. For those, who wish to become a patent agent, need to follow certain steps and guidelines as laid out by the United States Patent and Trademark Office (USPTO).
Like every other career or position, the position of a patent agent too has certain basic pre requisites. The USPTO requires that individuals applying for patent agents are citizens or foreigners in good standing. In case, you have been convicted of felony, you must provide some kind of proof for rehabilitation and reform.
The first step in the process of becoming a patent agent is to procure a bachelor's degree in the field of technology. Make note that the degree you opt for ought to be recognized by the USPTO. Alternatively, you could also have another recognized bachelor's degree. However, this will make you fall in the category A of the applicant bar. Some other degrees that are included in category A include degrees in physics, chemistry, biology, pharmaceuticals and many others.
In case, you have a degree in a different subject, you can still apply for a patent agent. But holding a degree in any other subject will make you fall into category B and C. As per the USPTO guidelines, you have several options to choose from, for your degree. These subjects are then clubbed with military service, course credits, alternative training, life experiences and the like for a final assessment.
If you are a B or C category applicant, then make sure that you submit your applications before hand. The reason for the same being that this will give more time for your applications to be processed. Applicants who fall in these categories are judged on a case to case basis. When submitting your application, make sure that you offer all the documentation possible to prove that you are skilled in technology.
Once you have been able to procure the position of a registered patent agent by the USPTO, you will be able to prepare, file and even prosecute patent applications. However, patent agents cannot deal with issues like patent validity, patent litigation and infringement cases. To deal with these issues, you need to be a patent attorney for which a degree in law will be required.
Becoming a patent agent is not a very easy task for sure. However, if you give it a honest and dedicated attempt, you will be able to get through for sure.
